January 30, 2019 “New” Pool Committee Meeting
The newly formed Pool Committee with Drew Anton as Chairperson held its first meeting nearly 5 months after the chair voted down to fund the pool project and design, that the 2018 board and owners had previously approved. That design project was previously approved by the majority of owners that voted and the 2018 Board of Directors and was submitted to the City of Boca Raton, (see history below) and was awaiting variance approval. Instead they discussed the survey that they had recently conducted. A pool committee member Sandra Spalletta questioned aspects of that surveys value and merit, as it failed to include any relative costs of amenities and options that would have a substantive potential impact on how a respondant might vote for or against them. She also challenged the chairperson who held meetings with vendors and others, yet as a committee member she was never informed nor invited to attend any of these meetings. To date, no summary or minutes for this meeting have been made available but it was clear from this survey that that the majority of respondants voted for a larger and shallower pool with almost all the design elements of the pool project of 2018 as previously submitted. The new pool committee offered no timeline toward, and reported little progress toward having any “new” designs to offer the ownership as the chairman had previously promissed would be provided “rapidly” back in November 2018. The new pool committee has never reached out to the previous Chairperson to discuss, review, or to receive any of the research or findings regarding pool equipment, pool designs, volume mitigation realities, geothermal cost valuations and investment returns, or for that matter, extended any interest in the anticipated 2018 design project so as not to waste time or additional owner resources and owner funding. This is enormous waste of all owners money and the costs will rapidly escalate to what is beleived to soon far exceed moving forward on the 2018 design as already submitted to the City of Boca Raton for Variance and permitting.

Just to confirm that this is an out and out lie on behalf of Karen Feller of 3000 South I categorically deny that conversation ever took place.
I find this to be slanderous on Karen Feller’s part and have had discussions with my attorney regarding same.

Four members of the Board of Directors (Drew Anthon, Karen Feller, Fred Benfredi and Gary Corona) blocked the funding of the South Deck / Pool project. As of now, the project has been discontinued indefinitely pending further action by these members. The remaining Board members believe this is a reckless and irresponsible course of action considering the condition of the deck and the Association’s extensive financial commitment to the project. The Board Members that blocked the funding of the South Deck Project have set the Association down a reckless, ill-advised and costly road. When a member of the audience asked Drew Anthon what his plan was now that he scrapped the project and how he was going to justify the wasted money and time, he simply shrugged his shoulders and said “we will tell them we are looking into it.” The frightening truth is that these Board Members do not have a plan. It was simply irresponsible to vote as they did without any data to support their promise of a “less costly pool option.” But don’t worry. They have a “strong belief” that they won’t be wasting your money or your time and they plan to “move quickly” to figure it all out.
We strongly believe that there are “new pool” options that will be less costly than the current project, and we plan to move quickly to explore them ........ In our efforts to act in the best interests of the ownership and to consider owners’ input, we believe that we could move forward with a new “new pool” design in a much quicker time than has occurred with the current project.”
Their “STRONG BELIEF” (unsupported by any due diligence) just cost the Association $150,000 in wasted preparation costs and at least two years of additional delays. That’s a tremendous leap of faith to ask the owners to take. These four Board Members knew the owners would be angry and concerned so within hours of the meeting they issue a self-congratulatory letter in which they endow themselves with the title of “protector of the people.” Despite having no plan to move forward, they still believe they know better than the owners and have the right to hijack the process, waste community funds and override the popular vote. All because they want to redesign the pool.

Dec 4, 2017 Little and Associates has submitted to Boca Raton for a Permit. Little and Associates has been gathering additional studies as subsequently requested by the Boca Building Department. Little has already made numerous previous submissions with each submission resulting in the City requesting another additional study or drawing. Additonal filed testing has since taken place on site including soil testing and engineering drainage plans being drafted and submitted. We are hoping this recent submission is accepted by the city which will alolow us to seek the additonal regulatory approvals.

July 5, 2017 BOD meeting was held and the South Deck/Pool committees recommended project manager, Little and Associates, was approved for managing the South Deck/Pool project. Project is being targeted to begin April/May of 2018 with a probable duration of 6 months if nature is cooperative through the construction months.
June 12, 2017 A Pool Committee meeting was held and members of the South Deck/Pool committee presented the results of their efforts to the residents of 3000 South. The meeting was led by Joe Largey and the minutes are posted here.
May 25, 2017 A Pool Committee meeting was held and 3 project manager candidates were interviewed. the meeting led by Joe Largey resulted in a unanimous decision from the 4 committee members who were present for recommending 1 of these project managers to the BOD’s at the next BOD meeting.
April 30, 2017 A Phone Conference meeting between the BC and the newly formed Pool Committee. was held to discuss the forward steps in the Pool and South Deck project. It was mentioned Phil McCafferty and Gene will not be project managers for the Pool project as they have been in the past for the Comprehensive Landscape, North Deck/Garage, and Electrical Power Distribution projects. It was recommended that the Pool Committee initiates a process of interviewing 3 or more project management candidates and choosing the best candidate.
March 6, 2017 A Site survey is being conducted to comply with the city’s request for inclusion in a varaiance submittal. ALL construction projects such as ours that are seaward of the CCL require this step which includes a submission for both our beach stairwell as well as the approved South Deck Pool project. The survey is an integral part of our entire variance package which will then be submitted to the City and will then have to be be approved by the City Council as well as the CAB before a construction permit will be issued. We must be patient for this process which requires being scheduled into hearing calendars and legal navigation through the entire administration process.
February 6, 2017 BOD Meeting
A vote was held on February 6th and the owners overwhelmingly chose to replace the current pool with a new pool design (5l-2l). The details of the project had been discussed by the Building Committee at numerous meetings (over several years) including an extensive Building Committee meeting held on December 7, 20l6. The proposal for a hot tub was not approved by the owners. The Board would like to thank you for your vote. We look forward to repairing and securing the seawall and enjoying a beautiful new pool deck with added amenities.
The next step in the project is to obtain the necessary variances and permits. To get this process started, the Association will need several surveys including: (l) Boundary, Topographic, Erosion Control Lone and Coastal Control Line Survey, (2) a Department of Environmental Protection Survey, (3) City of Boca Raton Variance 4A Survey, and (4) Hydrographic Survey. The Legal Committee is currently reviewing a contract for these services.
The following step will be to prepare and gather the necessary engineering documents so that the Association may solicit bids on the project. The commencement of the project depends on the time it takes to get all required variances and permits from the various governmental agencies. The Building Committee is still looking for volunteers to assist with this project.
SPECIAL ASSESSMENT FOR LEGAL FEES
The Association has incurred thousands of dollars in unexpected legal fees responding to two owners (Messrs. Anthon and Starvish) who have challenged the actions of the Board and the Association with regards to the Sea Wall / South Deck project and the funding of the reserve account. The legal fees date back to May 2016 and continue to date. The Association has received (through our counsel) a lengthy series of legal demands from the homeowners' attorneys dated May 24, 2016; July 8, 2016; August 26, 20l6; December 7,2016; December 14, 2016; January 3,2017; and February 6, 20l7. Several of these letters threatened arbitration/litigation and several others requested an extensive list of Association documents. Unfortunately, each of these demands must be reviewed, researched and a response prepared by Association counsel.
Over the past several years, the Association has been able to keep annual expenditures on budget. Funds to pay these additional legal fees have not been included in the current operating budget and therefore must be collected via special assessment. The amount of the special assessment will be determined by the Board Treasurer when the current legal invoice is received. An appropriate amount will be billed to each unit following all necessary formalities. If the Association receives additional correspondence, or arbitration is initiated as threatened, additional special assessments will be required.
